Is medical marijuana legal in Texas?

Yes. In 2015, the Compassionate Use Act made medicinal cannabis legal in Texas, though sales began in 2018. It is important to note that only low-THC, high-CBD cannabis is legal at this time. THC content may not exceed more than 1%.


Is recreational marijuana legal in Texas?

No, recreational marijuana remains illegal in Texas.


How do I qualify for a medical cannabis license?

To qualify, a patient of any age must be a permanent resident of Texas and suffer from one of the following conditions:

  • epilepsy;
  • a seizure disorder;
  • multiple sclerosis;
  • spasticity;
  • amyotrophic lateral sclerosis;
  • autism;
  • cancer; or
  • an incurable neurodegenerative disease*
  • post-traumatic stress disorder (PTSD)

From there, they are required to obtain a recommendation from an physician in the state. Previous state law required two physicians to sign off. That law has been amended to just one.

Do I need to be 18 years old to have a license?

No, persons of any age can possess a medical marijuana license in Texas as long as they meet the other qualifying criteria.


Where can I buy medical marijuana in Texas?

Patients can obtain their medical cannabis from state regulated dispensing organizations and nowhere else.


How much medical marijuana can I purchase?

Maximum allowances vary by patient and their physician’s recommended dosage.


Can a license holder grow their own medical marijuana?

No, only regulated dispensing organizations are allowed to cultivate, dispense or process low-THC medical cannabis in Texas.


Are patients exempt from criminal laws?

Yes, approved patients with a valid license are exempt from criminal marijuana possession laws as long as the product comes from a regulated dispensing organization.


Can I share my medical marijuana in Texas?

No, Texas law states that medical marijuana is intended for only the listed patient and cannot be shared with anyone else.


Can I buy medical cannabis for a friend in Texas?

Only patients and designated primary caregivers are allowed to purchase medical cannabis.


I’m from out of state, will Texas honor my medical marijuana card?

No, only permanent residents with a state-authorized license can purchase medicinal marijuana in Texas.


How will my products be packaged?

According to the Compassionate Use Act, specific criteria must be on each bag. The package must include the following:

  1. Physician's name
  2. Patient's name
  3. Dispensing organization's name, state license number, telephone number, and mailing address
  4. Dosage prescribed and means of administration
  5. Date the dispensing organization packaged the contents
  6. Batch number, sequential serial number, and bar code when used, to identify the batch associated with manufacturing and processing
  7. Potency of the low-THC cannabis product contained in the package, including the levels of tetrahydrocannabinol and cannabidiol (CBD)
  8. Statement that the product has been tested for contaminants with specific indications of all findings, and the date of testing in accordance with Code of Federal Regulations, Title 16, Part 1107
  9. Statement that the product is for medical use only and is intended for the exclusive use of the patient to whom it is prescribed. This statement should be in bold print.
